The site acts as a venue to allow merchant to offer, promote and sell about legal items at anytime, from anywhere, in a fixed price format. Big-Box.com.my is not involved in the actual transaction between shoppers and merchants. As a result, we have no control over the quality, safety or legality of the items advertised the truth or accuracy of the listings, the ability of merchants to sell items or the ability of shoppers to pay for items. We cannot ensure that a shopper or merchant will actually complete a transaction.

You agree, through your use of this service, that you will not use this website to post any material/image which is knowingly false and/or defamatory, inaccurate, harmful, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise in violation of any law. Note that all graphics displayed in listings may reside on our servers, but we do not and cannot control the images that are uploaded by our users. We expect that you will use caution and common sense when using our site. We are not liable for any images that have been placed on our servers, as they are beyond our control. However, a user may report to us by email should he notices any fraud. Big-Box.com.my reserve the right to withhold and/or remove any link/item that might possibly hold an individual, entity or group ridicule, potential embarrassment or potential defamation. Big-Box.com.my also reserves the right to accept, edit and/or remove any link/item that is deemed inappropriate in any way. You may not list on our site or sell any item using our site which:

1. infringes any third party's copyright, intellectual property, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy
2. otherwise causes legally-recognized harm (such as a product that contains a defamatory statement); or
3. is illegal under, or your sale to the buyer would violate, any applicable law, statute, ordinance or regulation.

Please note that there are also risks of dealing online. By using this site, you agree to accept risks and we are not responsible for the acts or omissions of users on the site. Because we are a venue, in the event that you have a dispute with one or more users, you release Big-Box.com.my (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our servers on listing or sale of items. You must be legally able to sell the item(s) you list for sale on the site. You must describe your item and all terms of sale on the listing page of the Site. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All listed items must be listed in an appropriate category. In your listings, you may not link to or include advertising for goods or services which

1. describes an item that you are not trying to sell on Big-Box.com.my
2. you do not have a right to link to or include

We reserve the right to remove members listing if found that:

1. Merchant's registration details and contact information is in-valid, not contactable, or misleading
2. Merchant has been suspended from trading for any other reason which against our guideline, rules and regulations.

Please remember that we are not responsible for any messages posted. We do not control the information provided by other users that is made available through our system. We do not vouch for or warrant the accuracy, completeness or usefulness of any message, and are not responsible for the contents of any message. The messages express the views of the author of the messages and are not endorsed by Big-Box.com.my

Due to the nature of the Internet is in real time, Big-Box.com.my does not, and cannot censor any submission in the live chat, any user who feels that a posted message is objectionable is encouraged to contact us immediately by email.

You also agree to defend, indemnify and hold harmless all of Big-Box.com.my, its Administrators, Moderators and its affiliates from and against all claims and expenses, including, but not limited to, attorneys' fees, legal claims, damages, settlements, awards, costs and proceedings arising out of your membership and use of your Big-Box.com.my account.

Your account remains the property of Big-Box.com.my, and you may not sell or otherwise profit from any part of your account unless granted express permission from the management of Big-Box.com.my. By registering your account, the management of Big-Box.com.my also grants you the permission to trade for profit at your own risk. User ID may not be transferred or sold to another party. Joining Big-Box.com.my as a merchant is free. However, we do charge fees if the merchant would like to get special features in our site. We may change our Fees for our services from time to time. However, we may choose to temporarily change our Fees and Credits Policy and the fees for our services for promotional events and such changes are effective when we post the temporary promotional event on the site. We may in our sole discretion change some or all of our services at any time. In the event we introduce a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in RM (Ringgit Malaysia). You are responsible for paying all fees associated with using our service and the Site and all applicable taxes. In no event shall we be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement. Our liability to you or any third parties in any circumstance is limited to the greater of the amount of fees you pay to us in the 12 months prior to the action giving rise to liability. Big-Box.com.my makes no warranty that:

1. the service will meet your requirements,
2. the site will be uninterrupted, timely, secure, or error-free
3. the results that may be obtained from the use of the service will be accurate or reliable
4. any errors in the software will be corrected.

You agree to indemnify and hold us from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party. We may amend this agreement at any time by posting the amended terms on our site. The amended terms shall automatically become effective after they are posted on our site. Your continued use of this site constitutes the following:

1. acknowledgment of this Agreement and any modifications; and
2. agreement to abide and be bound by this agreement, including any modifications.
